Acceptance of Orders
Unless explicitly agreed upon in writing and signed by an authorized GCW representative, all orders placed with GCW are subject to the following Terms and Conditions of Sale. Orders are only considered binding once formally accepted in writing by an authorized GCW representative. Any additional or conflicting terms proposed by the Buyer are expressly rejected and will not be incorporated into the agreement. These Terms and Conditions supersede all previous agreements and may be updated at any time without prior notice. Modifications must be made in writing and signed by both Buyer and an authorized GCW representative. Items sold are NON Cancelable and NON Returnable (NCNR).
Order Acknowledgement
Upon acceptance, GCW will issue an order acknowledgment that outlines pricing and delivery details of your cable and/or wire. If there is any discrepancy between the acknowledgment and the Buyer's order, the terms in the acknowledgment will take precedence. All stock material is subject to availability at the time of purchase.
Pricing & Payment Terms
- Prices are stated in U.S. dollars and may be subject to adjustment due to government regulations or supply chain changes.
- Orders are subject to GCW’s Price Escalation Policy, as determined solely by GCW.
- Payment methods accepted: Credit Card, Check, Wire Transfer, or Net-30 for approved customers.
Taxes & Government Charges
All applicable taxes and government-imposed fees related to the sale, shipment, or use of products are the responsibility of the Buyer. A valid tax exemption certificate must be provided before shipment if applicable.
Shipping & Delivery
- Order Status: Buyers can track order status through their GCW account.
- Shipping Responsibility: Once a product is loaded onto the carrier, the title and risk of loss pass to the Buyer.
- Freight Charges: Unless otherwise stated, freight charges are prepaid and added to the Buyer’s invoice.
Loss, Damage, or Delay
GCW is not responsible for nonperformance due to circumstances beyond its control, including but not limited to:
- Labor strikes, governmental actions, natural disasters, supply chain disruptions, or transportation delays.
- In the event of a delay, GCW reserves the right to adjust shipment schedules accordingly.
Order Cancellation & Modifications
- Orders canceled prior to shipping may incur a 10% processing fee.
- Orders canceled after shipping are subject to a 35% restocking fee, plus return shipping costs.
- Rescheduled shipments are subject to any additional freight re-consignment fees.
Returns & Refunds
- Returns require prior authorization and must be accompanied by an approved Return Material Authorization (RMA) number.
- Standard stock items in saleable condition may be returned within 30 days of shipment, subject to a 35% restocking fee and freight charges which will vary depending on the product.
- Non-stock, special cut lengths stock and or custom-made products are NON Cancelable and non-returnable under any circumstances. Unless the delivery receipt clearly notes damaged or wrong material. when the goods are signed for by the driver the purchaser cannot return the items. In certain cases GCW will allow return authorization with accompanied by prior written approval.
- Items sold are NON Cancelable and NON Returnable (NCNR).
Warranty Policy
- Manufacturer’s Warranty: If applicable, products may be covered by the original manufacturer’s warranty. Claims must be made directly with the manufacturer.
- GCW Warranty: If a GCW product is not covered by a manufacturer’s warranty and has a manufacturing defect within one (1) year from the invoice date, GCW will either repair or replace the product at its discretion.
- Exclusions: GCW is not responsible for installation costs, incidental damages, or lost profits resulting from a defect. GCW's warranty applies only to OEM, commercial, or industrial buyers and excludes any implied warranties, including merchantability and fitness for a particular purpose.
Limitation of Liability
- GCW is not liable for lost profits, indirect, incidental, or consequential damages.
- The Buyer's sole remedy is limited to the cost of the product. GCW is not responsible for installation, labor charges, or removal costs related to defective products.
Indemnification & Hold Harmless Agreement
- The Buyer assumes full responsibility for any claims, injuries, or damages arising from product use, regardless of alleged negligence on the part of GCW.
- Buyer agrees to indemnify and hold GCW harmless against any legal claims, suits, or actions.
Patents & Intellectual Property
Since GCW does not manufacture its products, patent infringement liability rests with the original manufacturer. If notified of a claim, GCW will make commercially reasonable efforts to secure the Buyer’s rights under the manufacturer’s indemnity policies.
Corrections & Assignments
- GCW reserves the right to correct clerical or typographical errors in orders, invoices, and acknowledgments.
- This agreement is non-transferable without GCW’s written consent. Unauthorized attempts to transfer rights under this agreement are void.
Severability Clause
If any provision of these Terms and Conditions is found to be unenforceable or invalid, the remaining provisions shall remain in full effect.
Reel & Recycling Policy
- GCW uses non-returnable wooden/plastic reels whenever possible, which are included in the product price.
- Buyers may return used reels for recycling, subject to GCW’s recycling program guidelines if applicable.
